HC sets aside acquittal, imposes ₹1-lakh fine on convict

The Kerala High Court set aside an order of acquittal and imposed a fine of ₹1 lakh on a convict on the charge that he had filed two criminal appeals before a sessions court.

Between them, one resulted in the confirmation of sentence and the other in his acquittal. A Single Bench of Justice P.V. Kunhikrishnan observed that lawyers, litigants, and the court registry too must be cautious of such multiplicity of appeals, revision, and other proceedings arising from the same matter.

A sessions court had confirmed his conviction in 2012, after which he reportedly filed another appeal through another lawyer, following which he was acquitted by the court in 2016. The incident came to light after many years when a sessions judge noted the anomaly in the proceedings and sent a letter to the High Court. The High Court in turn initiated suo motu proceedings against the convict.
